1. Agreement to These Terms

By accessing or using uselumee.com (the "Site") or purchasing any product or service from Lumée (the "Brand", "we", "our", "us"), you ("you", "Customer", "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access the Site or use any of our services.

These Terms apply to all visitors, users, and others who access or use the Site or purchase from us. You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is greater), and capable of entering into a binding contract under applicable law to use the Site or place an order.

2. Products, Pricing, and Availability

We make commercially reasonable efforts to display our products and their colors, finishes, textures, materials, and packaging accurately on the Site. However, we do not warrant that product descriptions, images, pricing, shipping estimates, or other content on the Site is error-free, complete, current, or accurate. We reserve the right, at any time and without prior notice, to:

Modify or discontinue any product;
Correct typographical, pricing, or descriptive errors;
Limit purchase quantities;
Refuse or cancel any order, including after an order has been confirmed and your payment method has been charged, if we suspect fraud, an error, or a violation of these Terms.

Prices are displayed in United States Dollars (USD) unless otherwise noted, and do not include applicable taxes, customs duties, or shipping fees unless stated. We are not obligated to fulfill orders placed at clearly erroneous prices.

3. Orders, Payment, and Fulfillment

By placing an order, you make an offer to purchase the products at the prices and on the terms described. Acceptance occurs only when we send an order confirmation and dispatch the order. We may decline or cancel orders at our sole discretion.

You authorize us, and our payment processors, to charge your payment method for the order total, including products, taxes, shipping, and any applicable fees. You represent and warrant that you have the legal right to use the payment method.

Lumée works with third-party fulfillment partners to ship products. Shipping timelines posted on the Site are estimates, not guarantees. See our Shipping Policy for current lead times and tracking practices.

4. Returns and Refunds

Our Refund Policy is incorporated into these Terms by reference. Please review our Refund Policy for full details on returns, refunds, replacements, and the conditions under which they are honored.

5. Intellectual Property

All content on the Site — including text, graphics, logos, button icons, images, audio clips, video clips, data compilations, software, and the compilation thereof — is the property of Lumée Studio or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not:

Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its content;
Use any automated means — including bots, scrapers, or data-mining tools — to access the Site or collect content;
Use our trademarks, brand name "Lumée", logos, or proprietary product names without our prior written permission;
Reverse engineer, decompile, or otherwise attempt to extract source code from any software available on the Site.

6. User Conduct

You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site, or interfere with any other party's use of the Site. Specifically, you agree not to:

Submit false or misleading information;
Attempt to gain unauthorized access to any portion of the Site, our systems, or other users' accounts;
Use the Site to transmit harmful code, malware, viruses, or any other technologically harmful material;
Engage in chargeback fraud, including disputing charges for products you have received and not returned in accordance with our Refund Policy;
Resell Lumée products without prior written authorization.

7. Reviews and User-Submitted Content

If you submit a review, comment, photo, video, or any other content to the Site or any Lumée social channel, you grant us a perpetual, worldwide, royalty-free, sub-licensable, transferable license to use, reproduce, modify, publish, translate, distribute, and display that content in any medium for marketing, promotional, and operational purposes.

You represent and warrant that any content you submit is original, accurate, does not infringe on third-party rights, and complies with all applicable laws. We reserve the right to remove any user-submitted content at our discretion, without notice, and for any reason.

8. Disclaimers

The Site, all products, and all services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, Lumée disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, and any warranty arising out of course of dealing or usage of trade.

Health and beauty disclaimer. Products sold by Lumée are personal-care and beauty items, not medical devices or pharmaceutical products. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Results vary by individual; statements about product benefits — including timelines, visible changes, or wellness effects — describe typical user experiences and are not guarantees of results.

If you have a medical condition, sensitive skin, an allergy, or are pregnant or nursing, consult a qualified healthcare provider before using any beauty product. Discontinue use and seek medical advice if irritation, redness, or any adverse reaction occurs.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Lumée, its affiliates, officers, employees, agents, suppliers, fulfillment partners, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, loss of goodwill, or any intangible loss — arising out of or related to your access to, use of, or inability to use the Site or any product purchased from us.

In any case, our total aggregate liability to you for any claim arising out of or relating to these Terms, the Site, or any product is limited to the amount you paid for the product giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Lumée, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from (i) your use of and access to the Site; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your user-submitted content caused damage to a third party.

11. Force Majeure

Lumée shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemic or epidemic, governmental action, fire, flood, earthquake, supply chain disruption, courier delays, customs holds, labor disputes, internet outages, or failures of third-party services.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and applicable United States federal law, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms, the Site, or any product purchased from us shall be resolved exclusively in the courts located in Puerto Rico, United States, and you consent to the personal jurisdiction of such courts.

Before initiating any formal proceeding, you agree to first contact us at hello@uselumee.com and attempt to resolve the dispute informally for at least thirty (30) days.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions.

14. Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes are effective when posted to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

15. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Lumée regarding your use of the Site and supersede any prior agreements.
